Gamer Heroz respects the intellectual property rights of others and expects its users to do the same. ByPer the Digital Millennium Copyright Act (DMCA), our policy is to respond to any infringement notices and take appropriate actions under the DMCA and other applicable intellectual property laws.

Filing a DMCA Complaint

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this site, please notify our copyright agent as specified below. Your notice must include the following information:

  1. Identification of the copyrighted work that you claim has been infringed.
  2. Identify the material claimed to be infringing and where it is located on the site.
  3. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  4. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. You made a statement under penalty of perjury that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
  6. Your physical or electronic signature.

Upon receipt of a valid DMCA notice, Gamer Heroz will promptly investigate and remove any infringing content if necessary. We will also take reasonable steps to notify the user who posted the allegedly infringing material that we have removed or disabled access to the material.

Counter-Notification

Suppose you believe that your content was removed or disabled by mistake or misidentification. In that case, you may file a counter-notification with us by providing the following information to our designated DMCA agent:

  1. Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled due to a mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the federal court in your district or, if your address is outside the United States, for any judicial district in which the service provider may be found and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will promptly provide the original complaining party with a copy of the counter-notice and inform them that we will replace the removed material or cease disabling access to it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material will be replaced, or access to it will be restored in 10 to 14 business days or more after receipt of the counter-notice.
